Further from the daily advisory document preparation activity and representation, the Labour law praxis of our office includes the legal advisory activity in various significant complex projects – in the EU or third countries – aiming restructuring, outsourcing of certain activities or resulting in the application of the transfer of undertaking rules. We are specialized not only in the mainstream areas of employment law (e.g. collective redundancy, establishment and termination of employment) but also in employment litigation, employee incentives, the application of the transfer of undertaking rules, and immigration matters. When dealing with labour law matters – irrespective whether a local or a multinational company is our client – we have a deep understanding about the business needs of our clients and we offer our solutions by taking these circumstances into account.
INDIVIDUAL LABOUR LAW
Based on our experience, clients view employment and other labour law issues as a high priority. We can address this priority with extraordinary care because our lawyers have substantial experience in labour law matters.For individual labour law matters, we assist our clients by:
- drafting employment contracts – including those of executive employees
- advising on company restructurings
- implementing individual and/or collective mass redundancies
- preparing and reviewing labour handbooks, incentive schemes, internal policies including disciplinary and grievance policies, etc.;
- drafting restrictive covenants and other side agreements;
- carrying our employment due diligences;
- developing performance improvement procedures; and
- advising in outsourcing and issues related to the implementation of transfer of undertakings rules.
Although our primary aim is to prevent litigation, we also represent our clients in employment disputes.
As employment law rules are amended frequently, our Firm guarantees to keep our clients up-to-date and prepared for all amendments. We regularly provide our clients with newsletters about the amendments of the legal regulation.
COLLECTIVE LABOUR LAW
Our Law Firm has broad expertise in the field of collective labour law. We regularly provide advice to our clients in connection with collective labour law issues, further we participate in wage negotiations and negotiations during strikes carried out with trade unions. Taking the dispositive regulation of the Labour Code into account, we oftentimes give advice on drafting and amendments of collective bargaining agreements and their negotiations with trade unions. Further, our clients receive assistance in connection with the establishment of trade unions and/or workers' councils.
Due to our exclusive membership at Ius Laboris, we are participating in international (labour) projects on a daily basis. The focus of these projects has a wide range of variety where the key challenges are to provide our clients with advice and solutions that are on one hand in compliance with the Hungarian labour laws and on the other hand may be filled into the global structures. We took part in several projects, including the setting up a European Company, reviewing bonus and incentive schemes, advising on employee mobility issues, implementing cross-border transfer of undertaking plan, etc.
Questions in connection with the employment of foreign persons regularly arise in the frame of international and other projects, as well. In connection with employment within the territory of the EU we usually advise our clients not only on the possible employment solutions (e.g. assignment, "double" employment) however, also in connection with the related social security and pension law issues. We have extensive expertise in connection with the residence and employment of non-EU workers, since we assisted our clients on many occasions in connection with obtaining work and residence permits, furthermore, permits for family reunification, etc.
